OFFICIAL RULES FOR CORONA KARNAVALE 2023 COSTUME CONTEST

Admission to Corona Karnavale on Saturday October 28, 2023 at New City Gas is required to enter the contest. Contest closes on Sunday October 29th at 12:01AM EST. Open to residents of Canada, 18 years of age or older as of the date of entry.

• One (1) prize of $3,000 CAD to be won [$1,000 cash; $1,000 in credit for consumption at the venue, $1,000 donation to the non-profit association of the winner’s choice], and;
• One (1) prize of $2,000 [$500 in cash, $1,000 in credit for consumption at the venue, $500 donation to the non-profit association of the winner’s choice].

Odds of winning depend on the number of eligible entries received. Must correctly answer a mathematical skill-testing question to win.

CONTEST RULES

(the “Official Rules”)
Win one of the prizes of $3,000 Canadian dollars or $2,000 (the “Contest”).

1. ENTRY PERIOD & CONTEST PROMOTER.

The Contest is brought to you by the following entity (the “Promoter”): 7350121 Canada Inc d/b/a Salle des spectacles New City Gas. (“New City Gas”).

The Contest entry period (the “Entry Period”) STARTS on October 28th 2023 at 10:00PM EST and ENDS on October 29th 2023 at 12:01AM EST.

2. HOW TO ENTER.

Admission to the Event “Corona Karnavale” on Saturday October 28, 2023 at New City Gas is required to enter the contest. Admission can be purchased in advance via https://tixr.com/groups/newcitygas or at New City Gas, 950 Rue Ottawa, Montréal, QC, H3C 1S4. Entry is subject to these Official Rules, including without limitation the conditions of entry set forth below.

To receive one (1) entry into the Contest (an “Entry”), during the Entry Period:

1. Purchase admission to the Event “Karnavale” on Saturday October 28, 2023 at New City Gas via https://tixr.com/groups/newcitygas or in person at New City Gas, 950 Rue Ottawa, Montréal, QC, H3C1S4;
2. Present yourself at the Photo Booth located inside New City Gas during the Event at 950 Rue Ottawa, Montreal, QC, H3C1S4;
3. Have a photo of your costume taken, complete and submit a Registration Form before 12:00AM EST;
4. Follow New City Gas (@newcitygas) and Corona (@corona) Official Instagram accounts;

A person that successfully completes the above listed steps to submit an Entry to the Contest will be considered a Participant in the contest. Participants must have a valid and public (i.e. not “private”) Instagram account for your Entry to be eligible. The Contest is void outside of Canada and void where prohibited or restricted by law.

Promoter and any of its affiliates, are not responsible for lost, misdirected, late, unsent, incomplete, illegible or unintelligible entries or for inaccurate entry information, whether caused by the Participant or by any of the equipment or programming associated with or utilized in this Contest, or by any technical or human error that may occur in the transmittal of any entry or the processing of any function on the Participant’s computer system or the website. Promoter reserves the right, in its sole discretion, to disqualify any individual found to be tampering with the entry process or the operation of the Contest; to be acting in violation of these rules; or to be acting with intent to annoy, abuse, threaten or harass any other person. Any use of robotic, automatic, programmed or similar response methods will void all such entries submitted by such methods. Participants will be disqualified from the contest in the event they introduce or comment on any subject matter that may violate Instagram’s Terms of Use, community standards, or that is otherwise inappropriate as assessed in Promoter’s sole discretion.

Although this contest may be communicated, promoted, or administered by means of any third party social media or social networking service or site (a “Third Party Service”), Participants acknowledge that: (i) this Contest is not sponsored, endorsed or administered by, or associated with, any Third Party Service; (ii) Participants must comply with any applicable Third Party Service’s terms and policies (such as Instagram’s terms, policies and conditions of use); and (iii) any questions, comments or complaints regarding this Contest should be directed to the Promoter and not to the Third Party Service. By participating in this Contest, you completely release any Third Party Service of all liability in relation to any injury, damage or loss that may occur directly or indirectly, in whole or in part, from your participation. The Contest is in no way sponsored, endorsed or administered by, or associated with any said Third Party Service, including but not limited to Instagram.

By participating in this Contest, Participants:

(i) accept and agree to be bound by these Official Rules (which may be subject to change), including without limitation the eligibility requirement set forth below;
(ii) agree to be bound by the decisions of the Promoter and its representatives, or the Contest judge(s) (if any), which decisions shall be final, binding and conclusive on all matters relating to the Contest.
(iii) agree and acknowledge that Promoter has the right to modify these Official rules of the Contest in any way at any time, subject to any applicable provincial or federal law.

3. ELIGIBILITY

The Contest is open to residents of Canada only who are 18 years of age or older as of the date of entry;

The following individuals are not eligible to enter the Contest:

i) All employees, officers, directors and agents and their immediate families or any members of their households, regardless of relationship, of Promoter or any advertising agency or other company involved with the design, production, execution or distribution of this Contest are not eligible to participate in the Contest or to win any prizes. Any Contest entries received from an ineligible Participant will be disqualified;

The Promoter shall have the right at any time to require proof of identity and/or eligibility to enter the Contest. Failure to provide such proof may result in disqualification. All personal and other information requested by and supplied for the purpose of the Contest must be truthful, complete, accurate and in no way misleading. The Promoter reserves the right, in its sole discretion, to disqualify any Participant should such an Participant at any stage supply untruthful, incomplete, inaccurate or misleading personal details and/or information.

4. PRIZES AND SELECTION OF POTENTIAL WINNERS:

Contest Participants will enter for a chance to win a either a prize worth of $3,000 Canadian dollars (the “Prize”), or a prize worth of $2,000 Canadian dollars (the “Prize”).

The Promoter will select eight (8) finalists from all eligible Entries (“Semi-Finalists”), using a juried panel of its own directors or agents. Photos of these eight (8) Semi-Finalists’ costumes will be posted to New City Gas’ Official Instagram account (@newcitygas) on October 30th, 2023 on or about 12:00 PM EST, followed by two Instagram Story Polls, each containing four (4) of the eight (8) Semi-Finalists’ entries (the “First Round” of voting). Instagram users will have twenty-four (24) hours to submit a vote using the Instagram Story Poll feature (a “Vote”).

Based on the results of the First Round of voting, the two Semi-Finalists that received the most number of votes will become Finalists in the contest. Photos of these two (2) Finalists’ costumes will be posted to New City Gas’ Official Instagram account (@newcitygas) on October 31st, 2023 on or about 12:00 PM EST, followed by an Instagram Story Polls containing the two (2) Finalists’ entries (the “Second Round” of voting). Instagram users will have twenty-four (24) hours to submit a Vote.

The Finalist that registers the most Votes on the Second Round of voting will be considered the potential winner of the first prize (prize worth of $3,000 Canadian dollars) on November 1st. The Finalist that registered the second most votes will be considered the potential winner of the second prize (prize worth of $2,000 Canadian dollars). Promoter will notify the potential winners by Instagram direct private message on November 1st and said winner shall have five (5) days to contact Promoter, otherwise the prize will be deemed to be forfeited and another Contest Participant will be chosen.

In the event that a potential winner is disqualified for any reason, Promoter may select an alternate potential winner from the remaining Finalists. Winners are solely responsible for all applicable federal or provincial, and local taxes and any expenses associated with any prizes, associated directly or indirectly with redeeming the prize. In the event of a dispute as to the identity of a potential winner, the potential winner will be deemed to be the person name an e-mail address is listed on the Registration Form.

For avoidance of doubt, voting is open to the public, meaning any and all users that have an Instagram account.

To be declared the winner, the potential winner must correctly answer (as determined by the Promoter in its sole discretion) a time-limited mathematical skill-testing question administered by Promoter’s representative by phone and answered without assistance or mechanical or electronic aid; (ii) be in full compliance with these Official Contest Rules, and sign and return an acknowledgement and release of liability in the form presented by Promoter ( the “Release Form”) within the time period specified by Promoter in the Release Form and any other document as may reasonably be required by Promoter in its absolute discretion. The potential winner may be required to provide proof of identification to the Promoter, when claiming the prize or otherwise in connection with this Contest to facilitate the accurate identification of the Contest winner. Once confirmation of the Contest winner is complete in accordance with the terms of these Official Rules, the Promoter will coordinate the remittance of the prize. Failure by potential winner to comply with any of the requirement set forth in these Official Rules, he or she will be deemed to have forfeited his/her prize.

The potential winner may be disqualified, and, at Promoter’s sole discretion the prize may be awarded to an alternate winner, selected from all Semi-Finalists.

The following terms and conditions apply to the Prize awarded pursuant to these Official Rules:

1. (a)  All details related to the Prize, shall be determined by the Promoter and/or the Prize supplier(s) in their absolute discretion and as may be outlined herein and/or on the Prize or elsewhere indicated. Some restrictions may apply.
2. (b)  Winner is fully responsible for any and all applicable federal, provincial and municipal taxes (including any income and withholding taxes, if applicable). Winner is solely responsible for any and all additional expenses not included in the Prize.
3. (c)  Winner shall be solely responsible to ensure that they complies with any rules, terms, conditions, or policies in effect related to the redemption of the Prize as awarded, including but not limited to any restrictions or requirements related to Covid-19, such as vaccination requirements and/or testing.
4. (d)  No refund or compensation will be made in the event winner is unable to redeem the Prize for any reason whatsoever.
5. (e)  The Promoter has the right, in its absolute discretion, to disqualify and/or remove the winner if such individual is at any point uncooperative, disruptive, abusive, or unobservant of applicable rules, laws, regulations, or if such individual is likely to cause or has caused damage to person, property, or the reputation of the Promoter, or any other entity related to this Contest, as determined in the absolute discretion of the Promoter.
6. (f)  The Promoter has the right, in its absolute discretion, to disqualify and/or remove the winner if such individual is suspected to have cheated or otherwise manipulated the operation of the contest in their favour through dishonest means.
7. (g) Prize must be accepted as awarded, without substitution, transfer, exchange or assignment, unless otherwise determined in the absolute discretion of the Promoter. Except as expressly warranted herein, prize is provided “as is” without further warranty of any kind.

9. (i)  The Promoter reserves the right, in its absolute discretion, to substitute the Prize with a prize or a part of a prize (as applicable) of equal or greater value, without limitation, if the Prize or any part of the Prize cannot be awarded by the Promoter, for any reason.
10. (j)  Once awarded, the Prize may not be resold or commercially traded in any manner, directly or indirectly, and Promoter reserves the right to ban or disqualify any Participant from any contest, including future contests, should it reasonably believe such Participant to have acted or attempted to act in contravention of the foregoing restriction.

Declaration And Release Form

By entering this Contest, you: (a) agree to release and forever discharge the Promoter, and its respective parent and/or affiliated companies, any and all other companies associated with the Contest (including Prize supplier and suppliers of materials or services related to the Contest, as the case may be), and all of their respective employees, directors, officers, shareholders, agents, representatives, successors and assigns (collectively, the “Releasees”) from any and all actions, causes of action, suits, debts, dues, accounts, claims, damages or liability for any loss, harm, damages, costs or expenses,

including, without limitation, costs or losses related to personal injuries, death, damage to, loss or destruction of property, and rights of publicity, personality, privacy and/or intellectual property (each, a “Claim”) arising out of, or in any way related to, your participation in the Contest and/or the awarding, receipt, possession, use and/or misuse of the Prize (or any portion thereof), or any travel or activity that is related to the receipt or use of the Prize (or any portion thereof); and (b) agree to indemnify and hold harmless each of the Releasees from and against any and all Claims arising from (i) your breach of these Official Rules, including the breach of any representations or warranties contained herein, (ii) your participation in the Contest, (iii) your acceptance, possession, use and/or misuse of the Prize (or any portion thereof), if applicable, or (iv) the use of any Entry Material in accordance with the rights granted in these Official Rules.

Privacy: By entering this contest you consent to Promoter’s collection and use of your personal information for the purpose of administering this Contest in accordance with these Official Rules and selecting the Contest winner. All information collected by Promoter is subject to its privacy policy and information handling standards and practices. If you are selected as a potential winner you consent to Promoter’s disclosure of your personal information to any Contest prize provider(s) for purpose of prize fulfillment, as may be necessary. You understand and agree that, should your personal information be provided to any prize provider, your information will be subject to that prize provider’s privacy policy and information handling standards and practices. You further acknowledge and agree that, when you enter the Contest by means of a Third Party Service, any personal information that you share with or by means of such Third Party Service may also be used by the said Third Party Service in accordance with its own privacy policy.

The Prize claim documents for the prizes, namely the Release Form shall confirm the potential winner’s (i) eligibility for the Contest and compliance with these Official Rules ( including providing any evidence and/or confirmation of said compliance and eligibility); (ii) acceptance of the Prize; (iii) full release and forever discharge in favor of the Promoter and the Releasees; (iv) grant to the Promoter the unrestricted right, in the Promoter and its affiliates’ collective or individual discretion, to publish, reproduce, convert, broadcast, communicate by telecommunication, exhibit, distribute, translate, adapt and otherwise use and re-use the winner's name, photograph, likeness, voice, city and province/territory of residence, without compensation or further notice, at any time and from time to time, in any advertising or publicity carried out by the Promoter, or their agents, in any manner of media now known or hereafter devised, unless prohibited by law;

Promoter reserves the right, in its sole discretion, to modify, terminate, or suspend this Contest should viruses, bugs, unauthorized human intervention or other causes beyond Promoter’s control corrupt or impair the administration, security or fairness of the Contest. Entries are subject to verification and will be declared invalid if they are illegible, mutilated, forged, falsified, altered or tampered with or unlawful in any way. Entries submitted by unauthorized means or by spamming will be disqualified. Promoter is not responsible for any human or technological error that may occur in the processing of the Contest nor are they responsible for any error, omission, interruption, deletion, defect, communications line failure, theft or destruction of, unauthorized access to, delay in operation, transmission, or distribution of, or alteration of entries, whether caused by the sender, any of the equipment or programming associated with or utilized in this Contest, or otherwise.

5. REPRESENTATIONS AND WARRANTIES:

By submitting the Entry, you hereby represent and warrant that the Entry is original and you are authorized to make the Entry; no third-party consents are required in order for Promoter to make use of the Entry; the Entry and Promoter’s use thereof will not infringe any third party rights or interests, whether in copyright, trademarks, personality, privacy, or defamation; and you will indemnify Promoter for claims relating to such third party rights.

Limitation of Liability and Dispute Resolution:

Except where prohibited, each Participant and winners accepting a prize agrees that: (a) all issues and questions concerning these rules shall be governed by the laws of the Province of Quebec and/or Canada, as the case may be, without giving effect to any principles of conflicts of law of any jurisdiction; (b) any and all disputes, claims and causes of action at law or in equity arising out of or relating to this Contest or any prize awarded shall be (i) resolved individually, without resort to any form of class action; and (ii) filed only in the courts situated in the judicial district of Montreal, in the Province of Quebec, and Participant hereby consents and submits to the personal jurisdiction of such courts for the purposes of litigating any such disputes, claims or causes of action; (c) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, but in no event shall include attorneys' fees; and (d) under no circumstances will any Participant or winner be permitted to obtain awards for and hereby waives all rights to claim punitive, incidental, special, consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased.

Residents of the Province of Quebec may submit any litigation respecting the conduct of this publicity Contest to the Régie des alcools, des courses et des jeux for a ruling. Any litigation respecting the awarding of a prize may be submitted to the Régie only for the purpose of helping the parties reach a settlement.

Subject to any governmental approval which may be required, Promoter reserves the right, without prior notice and at any time, to amend or terminate the Contest, in whole or in part, or modify or suspend the Contest in any way, if it determines, in its sole discretion, that the Contest is (i) technically impaired or corrupted or that fraud or technical problems, failures or malfunctions, (ii) the failure of any Entry to be received for any reason, (iii) any injury or damage to any Participant’s or any other person’s computer or other device related to or resulting from participating in the Contest, and/or (iv) a combination of the above, have destroyed or severely undermined the integrity and/or feasibility of the Contest. In the event Promoter is prevented from continuing with the Contest and/or granting the prizes as contemplated herein by any event beyond its control, or any federal, provincial or local government law, order, or regulation, or order of any court or jurisdiction, then Promoter shall have the right to modify, extend, suspend, or terminate the Contest and in which case, Promoter shall not be required to award any prizes.

Personal Information:

By entering the Contest, Participants consent to the use of their names and cities of residence for publicity purposes by Promoter without payment or compensation.

Discrepancies:

In the event there is a discrepancy or inconsistency between the English language version and any other language version of these Rules or any Contest materials, the English version shall prevail, govern and control. In the event of any discrepancy or inconsistency between the terms and conditions of these Rules and disclosures or other statements contained in any Contest-related materials, including but not limited to the Contest entry form, or point of sale, television, print or online advertising, the terms and conditions of these Official Rules shall prevail, govern and control.
